Section 31
Election symbol
(1) Election symbols to be distributed to parties and candidates for the election will be determined by the Commission (2) Election symbols determined in accordance with sub-section (1) shall be provided to parties and candidates as prescribed.
(3) The election symbol provided under sub-section (2) shall not be used by the candidate or party of such party.
(4) After the election symbol has been awarded to a candidate by the Commission, if such candidate abandons his party or joins another party, the election symbol awarded to him shall not be changed. If such a candidate is elected, his/her membership will be revoked if the relevant party complains to the commission with proof.
(5) When awarding the election symbol to the candidate who will be elected first according to this section, the candidate of the party shall be awarded the election symbol determined for such party in accordance with sub-section (1). In this way, if the commission feels that there is a mistake or difference in the distribution of election symbols, the commission can change such symbols.
(6) The Election Officer will provide election symbols to the independent candidate who will be elected first from the group of election symbols determined by the Commission.
(7) When including the election symbols provided in subsection (5) and (6) in the ballot paper, they should be included in the following order:-
(a) The electoral symbol of the candidate of that party based on the number of votes received by the party represented in the Provincial Assembly immediately before the election by the proportional election system in the election of such Provincial Assembly,
(b) In the case of a party not represented in the Provincial Assembly as per Clause (a), the election symbol of the candidate of that party based on the order in which they are registered with the Commission for election purposes,
(c) the electoral symbol of such candidate based on the alphabetical order of the name of the independent candidate.
(8) Notwithstanding anything contained in sub-section (7), in the case of the first election held after the commencement of this Act, the ballot paper shall notWhen including punctuation marks, they should be included in the following order:-
(a) Based on the number of votes received by the party represented in the Legislature-Parliament in the Constituent Assembly Member Election 2070 under the proportional election system, the election symbol of that party's candidate,
(b) In the case of a party not represented in the Legislature-Parliament, the election symbol of the candidate of that party based on the order in which they are registered with the Commission for election purposes,
(c) the electoral symbol of such candidate based on the alphabetical order of the name of the independent candidate.
(9) Notwithstanding anything written elsewhere in this section, when distributing election symbols towards the proportional election system, the commission shall distribute the election symbols determined for the respective parties and when such election symbols are included in the ballot paper, clauses (a) and (b) of sub-section (7) shall apply.
